These Terms of Service ("Terms") form a legally binding agreement between you ("Customer", "you" or "your") and Ripe Hosts Ltd ("Ripe Hosts", "we", "us" or "our"), a company incorporated in England and Wales.

Ripe Hosts Ltd provides its services through its website and control panels. Web hosting management is available at cp.haghost.com (NodeWorx/SiteWorx) and radio streaming services are managed at radio.haghost.com (MediaCP). haghost.com is used as the domain for these control panels only.

By creating an account, placing an order, or using any of our Services (including Domain Services, Premium Web Hosting, Internet Radio Broadcasting / Streaming Services, or Web Design), you confirm that you have read, understood, and agree to these Terms in full.

1. Description of Services

Ripe Hosts provides the following core services:

  • Domain Services — Domain name registration, transfers, DNS management, and related services via ICANN-accredited registries and registrars.
  • Premium Web Hosting — Shared, VPS, and dedicated hosting environments for websites, email, databases, and applications, with resource allocations as specified in your chosen plan.
  • Internet Radio Broadcasting Services — SHOUTcast, Icecast, and compatible streaming server hosting, including control panels, AutoDJ functionality, bandwidth, listener capacity, and related tools.
  • Additional professional services (Web Design, etc.) as described at the time of order.

Specific resource limits, features, and pricing for each plan are detailed on our website and in your order confirmation.

2. Account Registration and Customer Obligations

You must provide accurate, complete, and up-to-date information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use.

3. Acceptable Use Policy (AUP)

You agree to use the Services only for lawful purposes and in accordance with these Terms. Prohibited activities include, but are not limited to:

  • Hosting, streaming, distributing, or linking to illegal, infringing, defamatory, obscene, hateful, or harmful content.
  • Violating any third-party intellectual property, privacy, publicity, or other legal rights.
  • Engaging in hacking, DDoS attacks, malware distribution, phishing, spamming, or any activity that compromises network security or the experience of other customers.
  • Resource abuse (excessive CPU, RAM, bandwidth, or storage usage beyond plan limits) that degrades service for others.
  • Using Radio Services to broadcast content without all required licences (see Section 4).
  • Any activity that may expose Ripe Hosts to civil or criminal liability.

We reserve the right to monitor usage and to suspend or terminate Services immediately, with or without notice, for any violation of this AUP.

4. Internet Radio Broadcasting Services – Specific Terms & Music Licensing

IMPORTANT – CUSTOMER IS SOLELY RESPONSIBLE FOR ALL LICENSING AND LEGAL COMPLIANCE

You acknowledge and agree that Ripe Hosts is a technical infrastructure and streaming provider only. We do not supply, license, curate, monitor, or assume any responsibility for the audio content, music, or other material you broadcast or stream.

You are solely and exclusively responsible for obtaining, maintaining, and paying for all necessary licences, permissions, and consents before any broadcasting or streaming begins. This includes (without limitation):

  • Public performance and mechanical licences from PRS for Music (UK) and any applicable Internet Radio Licence or Limited Online Music Licence.
  • Sound recording and performer licences from PPL (UK), including any Linear Webcast Licence.
  • SoundExchange licences (or equivalent) for digital performance of sound recordings where your service reaches United States listeners.
  • Licences from ASCAP, BMI, SESAC, or any other Performing Rights Organisation (PRO) in jurisdictions where your listeners are located.
  • Any direct licences required from record labels, artists, publishers, or rights holders.
  • All necessary licences for any “listen again”, on-demand, or archived content.

You represent and warrant that all content you stream does not infringe any copyright, trademark, or other intellectual property right, and that you will maintain accurate play logs as required.

Ripe Hosts has no liability for any claim arising from your failure to obtain required licences. Upon receipt of a valid complaint, we may immediately suspend or terminate the affected Radio Service(s) without prior notice and without refund.

Indemnification: You agree to indemnify, defend, and hold harmless Ripe Hosts Ltd from any claims arising out of your content, broadcasts, or licensing failures.

5. Custom and Enterprise Service Arrangements

IMPORTANT PROTECTION FOR HIGH-VOLUME AND CUSTOM CLIENTS

Ripe Hosts offers standard plans with defined resource allocations. These are intended for typical personal, hobby, and small-to-medium commercial use.

For significantly higher or specialised requirements (very high listener volumes, custom SLAs, dedicated servers, reseller arrangements, etc.), a separate written Enterprise Services Agreement must be negotiated and signed.

Until such an agreement is executed, the standard Terms, fair use rules, and liability caps in this document shall apply in full.

6. Domain Name Services

When using our Domain Services you agree that:

  • The domain name does not infringe any third-party rights.
  • All WHOIS/contact information is accurate and kept up to date.
  • You are bound by the ICANN UDRP and applicable registry policies.
  • Domain registration/renewal fees are non-refundable.
  • We may suspend, cancel, or transfer a domain as required by law or registry requirement.

7. Web Hosting Services – Resources & Fair Use Policy

IMPORTANT: "Unlimited" Hosting Plans Are Subject to Fair Use

Plans advertised as “Unlimited Websites”, “Unlimited Storage”, “Unlimited Bandwidth”, etc. are intended for normal, reasonable personal and small-to-medium commercial use only.

Ripe Hosts reserves the right to monitor resource usage and may suspend, throttle, or terminate any account that exceeds reasonable fair use limits.

8. Payment, Billing and Refunds

All Services are provided on a prepaid basis. Chargebacks will result in immediate account termination. Refunds are at our sole discretion except where required by law.

9. Service Availability, Uptime and Disclaimers

Services are provided on an “as is” and “as available” basis. We do not guarantee 100% uptime.

10. Limitation of Liability

To the maximum extent permitted by law, Ripe Hosts’ total liability shall not exceed the fees paid by you in the twelve months preceding any claim.

11. Indemnification

You agree to indemnify Ripe Hosts Ltd from claims arising from your use of the Services or breach of these Terms.

12. Termination and Suspension

We may suspend or terminate Services immediately for breach of these Terms or non-payment.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

14. Changes to These Terms

We may update these Terms. Continued use after changes constitutes acceptance.

15. Miscellaneous

These Terms constitute the entire agreement. If any provision is unenforceable, the rest remain in effect.
